(hereinafter: the “Website Owner”)

PERMISSION TO PUT RECORDED AND/OR PRINTED MUSIC ON TO THE SHULMUSIC.ORG WEBSITE AND TO DISTRIBUTE IT VIA THE INTERNET

1.    I the undersigned am an owner of rights (hereinafter: the "Owner") to the printed music, midi, or other digital files on the attached list (hereinafter: the "List") that I would like the www.shulmusic.org web site (hereinafter: the "Website") to make available for distribution (hereinafter: the "Music") without any obligation on my part, and to make said Music available through the shulmusic.org web site to any person for their use via the Internet, including through the Website and/or through affiliated sites, in such a format at the discretion of the Website Owner.

2.    In the case of Music in respect which I am not the sole Owner, such as involving music arrangements, attached is written permission from the other Owners, giving you permission to make the Music available through the shulmusic.org web site. Additionally, I agree to indemnify you should any claim be made against you in respect of an infringement of any claimed rights to the Music.

3.     Nothing in the aforesaid shall be understood, construed or interpreted as the Owner transferring their intellectual property rights or copyright to the Music to the Website Owner or to anyone else, including those who download the Music from the Internet, and full ownership of the Music shall remain in the ownership and copyright of the Owner. The Website Owner shall state on the web-page linking to the Music that any person downloading the Music may do so for their own personal use, and not for the purpose of any business, profit or financial gain including by selling or making any other type of transaction which involves the Music (hereinafter: an "Infringement of the Owner’s Rights") without the express consent of the Owner in writing.

4.      The Owner understands that the Website Owner does not have, nor shall he have, any responsibility of any kind for what happens to the Music when in the hands of end users, but the Owner shall retain full rights to act as the Owner deems fit should the Owner discover any third party acting in such a way as to constitute an Infringement of the Owner’s rights. In such a case, the Website Owner shall not be a party to such an action by the Owner, unless the Owner has proof that the Website Owner acted not in good faith so as to deceive the Owner.

5.   The Owner understands that it is the intention of the Website Owner to charge owners of music for website services in the future to help defray the various costs involved in providing the above services. The Website Owner hereby undertakes not to charge the Owner any fee, either now or at any time in the future, for offering the Music on the internet.

6.  The Website Owner reserves the right to delete the Music from the shulmusic.org website at any time and at his sole discretion.
